In order to ensure your correct identification as the data subject of the personal data subject matter of the request, we may request documents or other evidence that can verify your identity. In this case, you will be informed in advance.

5. How and for how long will your data be stored?

Your personal and corporate data collected by KURASHIKI will be used and maintained in our database solely for commercial purposes.

By and large, your data will be kept for as long as the contractual relationship between your company and KURASHIKI persists. If a business relationship is not feasible, personal and corporate data will be deleted from our databases or anonymized, except for situations legally provided for in article 16 of the General Data Protection Law, namely:

I – compliance with a legal or regulatory obligation by the controller;

II – study by a research body, provided that personal data anonymization is ensured, whenever possible;

III – transfer to a third party, provided that the data processing requirements established in said Law are respected; or

IV – exclusive use by the controller, with third-party access prohibited, and provided that the data is anonymized.

In other words, personal information about you that is essential for compliance with legal, judicial, and administrative determinations and/or for the exercise of the right to defense in judicial and administrative proceedings will be maintained, despite the deletion of other data.

I – Legal determination, request, requisition, or court order, with relevant judicial, administrative, or governmental authorities.

II – In the event of corporate transactions, such as mergers, acquisitions, and consolidations, automatically.

III – Protection of KURASHIKI’s rights in any type of conflict, including those of a judicial nature.

7.1. International Data Transfer

KURASHIKI’s Headquarters are in Japan, so we may share your data. Under these conditions, however, your personal data will be subject to the General Data Protection Law and other Brazilian data protection laws.

As mentioned in Topic 6, although we adopt high security standards to prevent incidents, there is no online page entirely free of risks. In this sense, KURASHIKI is not liable for:

I – Any consequences arising from the negligence, recklessness, or incompetence of users regarding their individual data. We guarantee and take responsibility only for the security of data processing processes and compliance with the purposes described in this document.

We emphasize that the responsibility for the confidentiality of access data lies with the user.

II – Malicious actions by third parties, such as hacker attacks, unless proven to have occurred due to negligent or deliberate conduct by KURASHIKI.

We emphasize that in the event of security incidents that may pose a relevant risk or damage to you or any of our users, we will notify the affected parties and the National Data Protection Authority about the incident and comply with the necessary measures.

III – The inaccuracy of information entered by the user in the records required for the use of data submission channels; any consequences arising from false information or entered in bad faith are entirely the responsibility of the user.
